Wrong Case, Torture, No Place to Appeal I am a citizen of the People's Republic of China. Being framed and trapped by Hong Kong investors Chen Li, Chen Hongyuan, my law consultant Mao Huiqing and his accomplice£¬I suffered a wrong case in 1995. The local Prosecutor in Hangzhou Xihu district detained me in July 15,1995. The local Court in Hangzhou Xihu district sentenced me six years' imprisonment for claiming bribe with wrong evidences. During July 15, 1995 to May 14, 2000, I suffered different mental and body tortures in custody and jail. I. Wrong case, Torture A. Wrong case 1.My counsel pointed out on the court, "Defendant was kept in custody for such a long time without the approving of the National People's Congress". Why did the public prosecutor make a lie in the Prosecuting Paper? 2.Key witness Chen Li did not sign his proof in March 21,1996. The public prosecutor delivered the proof to the court and the court finally accepted the proof. It made a joke! 3.The procurators in the interrogation in December 18,1995 claimed, "The thirty thousand H.K. dollars illicit money has been found". Why did such an important proof not show in the court? 4.Where was the so-called proof "the 1992's Chen Hongyuan law office's desk calendar"? Chen HongYuan wrote giving Du YuXiang and Wang ZhenZhou each another five thousands H.K. dollars on the calendar. Chen Li, Chen Hongyuan delivered the so-called proof to the Procuratorate in the early of June 1995. Why did such important evidence not show to court? 5.My "Criminality Confession" First came from the crime plot of my law consultant Mao Huiqing and his accomplice; Late came from the striking of "mental association", which I couldn't bear; Finally directly came from the cheating, threatening, hitting and booting of the procurators in the Provincial Procuratorate. 6."The illicit money" in my confession: At the first time I confessed that I deposited the thirty thousands H.K. dollars in the Bank. At the second time I confessed that I had lost the thirty thousands H.K. dollars in the Hong Kong street. At the third time I confessed that I had lost the thirty thousands H.K. dollars in PuJing betting site in Macao. 7.Many important proofs connecting with the case did not deliver to the court. The talk tape between Chen Li and me, which clearly proved that Chen Li and Chen HongYuan had made perjury; The several self-contradictory witness, which Chen Li and Chen Hongyuan had made to the Procuratorate; "The Event Told by Myself", which detailed recorded the course of my surrendering and disclosed the real facts of the case; The seven set of record tapes, which disclosed the criminal purposes of my law consultant Mao Huiqing and his accomplice; Other over twenty pieces of my inquiring papers and written materials, which reflected the truth behind the scene. 8.My counsel and I clearly stated above important facts while made an innocent defend on the courtroom. However, the holiness court, hanged with bright mirror, did not see the facts at all and unjustly sentenced me six years' imprisonment for demanding bribe. Where was the justice of the law? 9.Hangzhou Intermediate People's Court declared Du YuXiang, who is involved in the same thirty thousand HK dollars' case with me, innocent for above thirty thousand HK dollars' case. B. Torture 1.I was secretly locked up in the custody for near one year and ten months, where I almost lost any relations with outside world. (1995/7/15 to 1997/5/5) 2.During my staying in the custody and jail, there is a set of very advanced machine, which produced my "mental association". On the eve of March 19, 1996, I was almost broken down under the mental association. I had to confess guilt. 3.During my staying in the custody and jail, there is a set of very advanced machine, which always carried through physiological torture to me such as unexpected paralysis, extremely headache, hand ache, diarrhea etc. Nearly in November 20, 1996 in Xiaoshan custody, the machine made me paralyzed. I had no choice but to lie on the cage board and could not move any more. I would felt painful even with a slightly moving. I needed others' helps for everything including going to toilet. I lied on the cage board for whole three days. I ever shouted out for "Saving Life" two times in the cages when I could not bear the machine torture. 4.During November 28,1996 to December 25,1996, I was brought to Hangzhou Yuquan Hotel by Provincial Procuratorate. In the room of Yuquan hotel, the procurators of Provincial Procuratorate fixed me by the additional bed with handcuffs. I suffered from their insults, palm or feet boot. I was forced to confess guilt under their high pressure. 5.In a no-window-small-room in Guangan rest house, I had to write down my so-called private life on the paper and handed over these paper materials to the procurators several times under the pressure. 6.There were always too many detaining persons in the cage. One person's head often touched with another's feet in the evening sleep in the cage. Being afraid of squeezed in the middle, I usually slept near water pool and water closet. 7.In order to escape this rattrap, I stopped eating once. 8.During my staying in custody and jail, all the time I survived in a humiliated circumstance permeating with rough stuff, where I suffered from sprit and physiological torture. II. The History Retrospect for the Wrong case and Torture A. Giving Myself up to the Police (1995/2/27 to 1995/3/1) * Around the Spring festival in 1995, the Hong Kong investors of the Hongfu Village Chen Li, Chen Hongyuan faked a wrong case against Du Yuxiang and me. The wrong case is, "It was at the second day when Du Yuexiang and Wang Zhenzhou arrived in Hong Kong during the period of China (Hong Kong) Real Estate Exhibition in July 1992. On the breakfast table in the International Conference Center, Chen Li gave general manager Du Yuxiang, deputy general manager Wang Zhenzhou of the Hongfu Village each an envelope with thirty thousand H.K. dollars. The envelope was from the law office where Chen Hongyuan served. Du Yuxiang demanded for the money." Based on this fabricated story, Liu Zhiyong (Deputy general manager of Zhejiang Economic Construction Investment Corporation) and Mao Huiqing (Director of the law affairs of Zhejiang Economic Construction Investment Corporation; my law consultant in Hangzhou City Commercial Hotel) reported the case to Hangzhou Xihu District People's Procuratorate under the name of Zhejiang Economic Construction Investment Corporation. Fang Jincai (Director general of the Corruption and Bribery Spying department in Hangzhou Xihu District People's Procuratorate) and Guo Lianzhong (Deputy chief of Xihu District Procuratorate in Hangzhou City) began the investigation about the fabricated case. * In the 8:30 A.M. of February 27, 1995, my law consultant Mao Huiqing (Hangzhou City Business Hotel) asked me to have an appointment in Lily Hotel. Hiding his real identity as the reporting personnel in the case, my law consultant Mao Huiqing carried a secret spy towards me. About 11:00 A.M. in the evening, my law consultant Mao Huiqing cheated me to Lingfeng Village to have a chat with his friends in the Procuratorate. In the late evening, director general Fang Jincai, deputy chief Guo Lianzhong of Xihu District Procuratorate detained me without any law procedure. During the period, director general Fang Jincai, deputy chief Guo Lianzhong had severe out-of-discipline words and deeds in forcing me to confess guilt. * It was near 8:30 p.m. in room122 in Lingfeng Village in February 28,1995. Procurator Song Yong and another procurator began to question me. I wrote down paper for the summon for trial. During the question period, I frankly told the activities in 1992's China (Hong Kong) Real Estate Exhibition about Du Yuxiang and me. Besides Chen Hongyuan presented Du Yuxiang and me each one suit of western-style clothes, I didn't accept any other money or valuable things from Hong Kong investors of Hongfu Village. Through the dialogues between Song Yong and me, I knew what kind of thing I was connected with. "It was the second day after our arriving Hong Kong. It was at breakfast time in the International Conference Center. There were five people then and there. They were Chen Hongyuan, Chen Li, Li Yianting, Du Yuxiang and Wang Zhenzhou. Du Yuxiang demanded for the intercommunicating fees. The money was put in an envelope. The envelope was from the Law Office." * It was about 4:30 in the afternoon of that day when lawyer Mao Huiqing came into room 122. There were three people in the room at that time: Song Yong, another Procurator and I. Mao Huiqing: (He seemed very excited.) Wang Zhenzhou, I just came over from deputy chief Guo. I asked your thing, but deputy chief Guo was very angry. Deputy chief Guo said, "Wang Zhenzhou is not worth your help. He doesn't confess up till now. Du has begun to confess now. You need not to care about him." I said, "Whether is there a possibility that Wang Zhenzhou really don't have?" Deputy chief Guo said, "It is impossible. Please look at the material." I was stunned when I saw the materials. It was so clear. Both testimony of witness and material evidence are present. It would not have any method to deny. Yesterday evening, I did not speak at the all time and I intended to believe you. But it is totally different today. Wang Zhenzhou, you may still have some doubts about me. I, Mao Huiqing, could fish out my heart to you. If I, Mao Huiqing, deceived you, I would be killed by God and struck by Thor. You could treat me as long as you like later. Du Yuxiang is a five or six hundred thousand Yuan's case. There is no need for you to follow him to stay in the jail for whole life. He, general manager demanded the money and the Hong Kong side paid for him. You, deputy general manager just followed him to take. There is no big problem for you. If you don't speak today, then you must be put into the Lao Dongyue (the custody). I have asked deputy chief Guo, "Let me have a chance to talk with Wang Zhenzhou." Deputy chief Guo agreed. If you speak now, you can still be counted to give yourself up to the Police. You can go home tonight. Wang Zhenzhou: (Through one day and one evening's detaining, I thought to go out first. Du Yuxiang has gotten a big trouble this time. The Procuratorate has taken actions to him. Now he has begun to confess. The Hong Kong investors, Chen Li and Chen Hongyuan, have made a trick on me. They added my name on Du Yuxiang's materials. If I do not acknowledge, I will be put into custody today. After seeing the materials, Mao Huiqing comes to rescue me. Therefore, I decided to acknowledge the thing and went out first. Other things could be dealt with after my going out. But, I still did not know the exact amount in the envelope.) Wang Zhenzhou: Oh! There is such a thing. It was the second day when we arrived in Hong Kong. It was at the breakfast table in the International Conference Center. Chen Hongyuan, Chen Li, Li Yanting, Du Yuxiang, and I had a breakfast together. Chen Hongyuan gave each of us an envelope. The envelope was from his Law Office. There were ten thousand H.K. dollars in the envelope. (I guessed because I did not know the exact number in the materials. I was looking at Mao and hoping to get some hints while I spoke.) Mao Huiqing: No response. (I knew I made a wrong guess from his countenance and manner.) Wang Zhenzhou: There were thirty thousand H.K. dollars in the envelope. (I continued to guess. I was looking at Mao and hoping to get some hints.) Mao Huiqing: (No words. There was something on his countenance and manner. But I did not know whether my guess is wrong or right.) Wang Zhenzhou: Thirty-two thousand. (I continue to guess. I am looking at Mao and hoping to get some hints.) Mao Huiqing: It has been for a long time. You yourself are likely to have a bit muddles. (His tone and expression prevent me from continuing guess.) Song Yong: I already said you have to say finally. You do not say it here today. You have to say it tomorrow after being put into custody. Wang Zhenzhou: No words. (I understand my guessing number is near. But, I still couldn't sure it is thirty thousand or thirty-two thousand.) * Under the misled of my law consultant Mao Huiqing's cheat, threat criminal words and deeds, I made a mistaken judgment to the happening things around me. In order to escape the place quickly, I dropped into the trap of my law consultant Mao Huiqing and his complice finally. I confessed a quilt, which I did not have in fact, to Hangzhou Xihu District People's Procuratorate. I confessed, "It was the time when I was director, deputy general of Zhejiang Hongfu Village Real Estate Investment Limited Company. It was the second day when I arrived in Hong Kong in the China (Hong Kong) Real Estate Exhibition in July 1992. At the breakfast table in the International Conference Center that day, I received an envelope with thirty-two thousand H.K. dollars from Hong Kong Investor Chen Hongyuan. At same time I testified Du Yuxiang took an envelope from Chen Hongyuan either. I don't know the practical number Du Yuxiang took. " B. After Being Bailed out Waiting for Trial (1995/3/1 to 1995/7/15) * It was about 10:30 a.m. of March 1, 1995. Mao Huiqing and I had following talks in my car(I drove the car): Mao Huiqing: Du Yuexiang is totally destroyed this time. He was tremble all body when he was gotten penal custody yesterday. Du Yuexiang is destroyed. Mao Huiqing: Have you talked about it after taking the money? Wang Zhenzhou: No. Mao Huiqing: How much are there in Du's envelope? Wang Zhenzhou: I don't know. Mao Huiqing: I tell you, "You should say that Du and you have talked about the money after taking the money. There are thirty thousand H.K. dollars in Du's envelope either." Wang Zhenzhou: I paid no response. (Now I feel something wrong with Mao Huiqing. He asked me to fabricate something that I have state clearly to him. He wants to frame other.) Mao Huiqing: You should restate the point that Du demanded for the money from Hong Kong investors. He, general manager demanded for intercommunicating fees, and you, deputy general manager just followed him to take. It is no problem and very common. Wang Zhenzhou: I paid no response. (I doubt I probably have fallen into Mao Huiqing's trap on this matter.) * It was in March 6, 1995 in the telephone Mao Huiqing asked me to forge my surrendering cause like "That day I had a talk with my law consultant. By the way, I asked him a law question. One year I followed general manager Du to Hong Kong and general manager Du demanded for some intercommunicating fees from Hong Kong investors. I followed him to take the money either. I thought it would be no problem to follow general manager to take the money. Heard my words, Lawyer Mao Huiqing found it was a big problem and brought me to the Procuratorate at once."(Recorded. The recorded tape has handed to Hangzhou Xihu District People's Procuratorate) * My law consultant Mao Huiqing and Procurator Fang Jincai together demanded me to make a wrong witness. They asked me to change to forge my surrendering cause like "That day I had a talk with my law consultant. By the way, I asked him a law question. One year I followed general manager Du to Hong Kong and general manager Du demanded for some intercommunicating fees from Hong Kong investors. I followed him to take the money either. I thought it would be no problem to follow general manager to take the money. Heard my words, Lawyer Mao Huiqing found it was a big problem and brought me to the Procuratorate at once."(Recorded. The recorded tape has handed to Hangzhou Xihu District People's Procuratorate) * In the evening of April 17, 1995, I came across Chen Li in the Western-style food hall in Hangzhou Dragon Hotel. In our over two hours' long talk in hotel, my car and his home"(Recorded), Chen Li totally denied that he ever accuse Du Yuexiang and me taking thirty thousand H.K. dollars. Chen Li said: "Wang Zhenzhou, I am surely not the party for the thirty thousand Hong Kong dollars' case. I never presented thirty thousand H.K. dollars to your hands or Du Yuexiang's hands in my hands. No one asks me whether you have given Du Yuexiang and Wang Zhenzhou each thirty thousand H.K. dollars once. You are party. If you asked, I cold go to the Procuratorate to bear my witness. I could go now." Under my insisting, Chen Li wrote the following proof to me: "According Mr. Wang Zhenzhou's request, I myself testify that I haven't presented Du Yuexiang and Wang Zhenzhou each an envelope with thirty thousand H.K. dollars after some day's breakfast in Hong Kong International Conference Center in 1992. I have never heard of such thing either. Chen Li, April 18, 1995". Chen Li's paper proof and our talk's record tape have handed to Hangzhou Xihu District People's Procuratorate in May 2,1995. * Around May 5,1995, Chen Li changed his witness to Hangzhou Xihu District People's Procuratorate: "I only presented five thousand H.K. dollars to each of them. I did not present thirty thousand H.K. dollars to each of them." * Around May 22, Chen Hongyuan changed his witness to the Procuratorate in Shenzhen, "Among the thirty thousand H.K. dollars given to Du Yuexiang and Wang Zhenzhou, we lent twenty-five thousand H.K. dollars to them and presented them the rest five thousand H.K. dollars." * Around May 25, Chen Li wrote a letter to Xihu District Procuratorate. He said in the letter, "Both things, 'They gave Du Yuexiang and Wang Zhenzhou thirty thousand H.K. dollars each and five thousand H.K. dollars each', are existed." * Around June 8, 1995, Chen Li and Chen Hongyuan provided new perjury "the 1992's Chen Hongyuan law office's desk calendar where Chen HongYuan wrote giving Du YuXiang and Wang ZhenZhou each another five thousands H.K. dollars" C. Custody and Jail (1995/7/15 to 2000/5/14) * I was soon secretly put into cage three in Yuhang Custody after I was penal custody in July 15,1995. After five months' detaining, I fell into a mental association trap around December 15,1995. I got a heavy headache and felt exciting in the daytime. I could not get slept in the whole night. I was losing my memory obviously. I felt poisoned. The culprits' speaking and behavior became strange. Like someone has arranged, every culprit in the cage would come and ask me one or two questions. Then they would go to a side and write something on a paper. It seemed they recorded something about my answers. They asked me some indescribable questions. I did not know what their purposes were. I was afraid to answer their questions. * I doubted it was a psychological test of the Procuratorate. It might be the reason why I was still kept in the custody after five months. I could not bear the mental association trap. I did not want to accept such kind of psychological test either. I hoped that the culprits could come back to the normal conditions. I tried to move the culprits' hearts with my true feelings and to stop the psychological test. I told the culprits in tears, "It is a very dangerous test. It is illegal. Have you seen an American film ¡ÜThe Desired Streetcar¡Ý? A normal person was finally put into a mental hospital." They just listened to me silently and someone delivered me a piece of towel to wash my tears. They said, "We don't have methods either. The test results may be helpful to you. They may release you after the test." Soon, they began to raise questions to me again. I felt much deeper horrible. * Because of stopping eating and fighting with the culprits, I was being put into a much horrible cage. The culprits in the cage openly imitated the dialogues and simulate scenarios in my private life. The culprits with clear characteristics on them, seem to represent some women who I was familiar with before. Presently my mental association was much heavier. I would think of some woman's sex when I saw a hole on the wall. I felt horrible for my mental association. While I was just in fear and trembling, some culprit came and asked me the meaning of "in fear and trembling". It was a heavy struck just on my head. I didn't dare to see their performance and listen to their talks. I lied on the plank at once. I lost strength to be a normal culprit in the cage. * During March 19, 1996 to June 19, 1996, I confessed my so-called guilts many times to deputy chief Qian, Zhongxian in the Province Procuratorate, deputy chief Ma Shouzhong and section chief Qin in the City Procuratorate£¬and procurators in Xihu District Procuratorate under my mental association. I confessed taking thirty thousand H.K. dollars once but I lost the thirty thousand H.K. dollars' illicit money in Hong Kong street. I also confessed taking five thousand H.K. dollars either. I further randomly disclosed a lot of leaders in Xihu District Procuratorate, in the City Procuratorate, in the Province Procuratorate, in the Province People's Congress, in the Province Public Security Department, in the Province Planed and Economic Commission under my mental association. All those officials had taken bribe and went whoring behaviors. They took the bribe from fifty to three hundred thousand R.M.B. Yuan each one each time. We have had many meetings. I have written down the meeting records and bribery amount for each official. I put all these documents in my rented safe: One in the Construction Bank, One in the Industrious and Commercial Bank and One in the Agricultural Bank. * I have had a qualitative understanding about the mental association through the long time association stimulus. In fact the mental association is very simple. It created by a piece of most advanced machine. They could get my memory messages directly and could know my past and present through the machine. They could control my memory ability through the machine. Besides my thinking, the machine could control almost all of me. They could directly deliver the mental association into my brain through the machine. The machine is somewhat like a recorder and television. I gradually shook off from the fear to the mental association after I understood the roots of my mental association. I began to suffer different kinds of strikes since I didn't obey the mental association instructs. During the time, I often would have heavy headache and swell. One day in late August, I could not breath calmly and I had to shout "Saving life" in the cage. My thigh and hand would suddenly lost strength. Around November 20, I paralyzed wholly and lied on the plank without any slight moving. I would need others' help even I went to the lavatory. I lied on the cage plank for whole three days. The most unbearable thing was the body contacts among the culprits in the cage during the time. Usually they would put over twenty culprits in this about thirty square meters cage. The culprits would fill the entire cage in the evening both on the plank and on the ground. One person's head would connect with another one's feet. Being afraid to be put in the center, I usually chose to sleep on the end. Usually it would be near pond or lavatory. * At the afternoon in November 28, 1996, the Procurators in Province Procuratorate brought me to the room 119 in Hangzhou Yuequan Hotel. It was the morning of November 30, 1996. Because of my written letter, the Procurator in the room ordered me to stand by the wall and fixed one of my hands on the added bed at once. Several minutes later, three Procurators came in. They gave several slaps on my face and kick my legs several times. I leaned against the wall after being hit by them. A moment later, another three Procurators came into the room. They ordered me to stand well, but I didn't obey. They began to hit me again. They also made several slaps and kicks on my face and legs. At this time, I did strike back, but I didn't catch them. I just lied on the ground after being hitted. * In April 18, 1997, Xihu District People's Court, sentenced me six-year imprisonment for demanding bribe clearly lacking of evidence. My counsels and I made an innocent vindication on the courthouse. Many important related evidences have not delivered to the courthouse: The talk tapes between Chen Li and me in Hangzhou Dragon Hotel; The several self-contradictory witness that Chen Li and Chen Hongyuan have made to the Procuratorate; "The Event Told By Myself"; Other over twenty pieces of interrogating papers and written materials, which I made to the Procuratorate and reflected the facts of the case; My confessions to the Procuratorate about the direction of thirty thousand H.K. dollars' illicit money; The Procurators declared, "The thirty thousand H.K. dollars deposit has been found" in the interrogating in December 18, 1995. Why such important proof did not show to the courthouse? The seven tapes that disclosed the criminal facts of my law consultant; * At that time I believe this is a torture spying experiment made by the Chinese Procuratorate. Since the courthouse could judge me for crime clearly lacking of evidence, it was meaningless to appeal to a higher court in the experiment cycle. It would only increase my time and pain in the custody. I wanted to see my family as early as possible. I also expected to escape the devised body contacts between culprits in the custody. It was said, "Every one would have a bed in the jail. It was also allowed to see books in the jail." I decided not appealing to a higher court and went to jail early. * I served a sentence in Hangzhou South-suburb Jail from May 5,1997 to May 14,2000. I was released after I finished my sentence. III. No Place to Appeal In May 14, 2000, I was released after severing four years and ten months' imprisonment. I wrote My Telling in Chinese, which described the whole process of the wrong case, torture and my own suffering in the custody and jail. It also disclosed the connected-peacebreaker of the wrong case. The creating of the wrong case connects with some procurators in Zhejiang Province, Hangzhou City and Hangzhou Xihu District Procuratorate, including several provincial leading carders in legal department. I also wrote to the Central Discipline Inspecting Commission of CPC, the Legal Commission of National Congress, the Letter-visiting office of National Congress, the Letter-visiting office of State Council, the Legal minister and domestic main media. But I haven't gotten real responses either. Not only the wrong case brought disasters to me in the past but also the misfortune to me at present. Because of my wrong case, my shared hotels and mansion have been declared broken down or stopping operate. The local procurators even took my private bonds to pay so-called company's debts. The long-term appealing caused me huge hurt both in my heart and health. All I suffered came from the fabricated thirty thousands H.K. dollars' wrong case. During my staying in custody and jail, all the time I survived in a humiliated circumstance permeating with rough stuff, where I suffered from sprit and physiological torture. * Declaring 1: I believe that the later part of my wrong case and torture (since my surveillance dwell) is a torture spying experiment made by the Chinese Procuratorate when I wrote My Telling in Chinese. I though "The torture spying experiment" should accept the law examine. * Declaring 2: Now I firmly believe "Despite they are individual behavior or group behavior and despite they have what purposes, the peacebreakers of the wrong case, the producers of the torture and the law responsible persons who block the correction of the wrong case, all have offended the current existing Chinese law and effective International agreement". They should accept the judge made by Chinese Court. Now I ask social supports to forward or public my wrong case to the world. To push the Highest People's Procuratorate and Court in China to correct the wrong case, to punish real criminals and to safeguard the legal rights and interests of a common Chinese citizen. Social justice could be promoted.
